1. การยอมรับข้อกำหนด

การเข้าใช้งานหรือสมัครบัญชี Transforza ถือว่าคุณยอมรับข้อกำหนดเหล่านี้ทั้งหมด หากไม่ยอมรับ กรุณาหยุดใช้งานบริการ

2. คำอธิบายบริการ

Transforza เป็นแพลตฟอร์ม SaaS ที่ใช้ AI ช่วยวิเคราะห์ความเสี่ยงด้าน Compliance, GRC และกระบวนการทำงานขององค์กร โดยอิงตามมาตรฐานสากล เช่น ISO 27001, PDPA, NIST, SAP S/4HANA, Microsoft D365 F&O

ข้อจำกัดสำคัญ: ผลการวิเคราะห์ของ Transforza เป็นเพียงการให้คำแนะนำเบื้องต้นโดย AI ไม่ใช่คำปรึกษาทางกฎหมายหรือวิชาชีพ ผู้ใช้ต้องตัดสินใจและรับผิดชอบต่อการดำเนินการด้วยตนเอง

3. บัญชีผู้ใช้และความปลอดภัย

• คุณต้องให้ข้อมูลที่ถูกต้องและเป็นจริงในการสมัคร
• คุณมีหน้าที่รักษาความลับของรหัสผ่านและ token ของตนเอง
• กรณีสงสัยว่าบัญชีถูกเข้าถึงโดยไม่ได้รับอนุญาต ต้องแจ้ง hello@creativevaluation.com ทันที
• Transforza ไม่รับผิดชอบต่อความเสียหายที่เกิดจากการที่คุณเปิดเผยข้อมูลเข้าสู่ระบบ

4. ข้อห้ามในการใช้งาน

• ห้ามใช้แพลตฟอร์มเพื่อกิจกรรมที่ผิดกฎหมายหรือเป็นอันตรายต่อบุคคลอื่น
• ห้ามพยายาม reverse engineer, decompile หรือเข้าถึงซอร์สโค้ดของระบบ
• ห้าม scrape, bot หรือ automated access นอกเหนือจาก API ที่ได้รับอนุญาต
• ห้ามส่งข้อมูลที่เป็นอันตราย malware หรือเนื้อหาที่ผิดกฎหมาย
• ห้ามแชร์ account ระหว่างองค์กรที่แตกต่างกัน

5. ทรัพย์สินทางปัญญา

Transforza เป็นเจ้าของโค้ด UI/UX โมเดล และ infrastructure ทั้งหมด ผู้ใช้เป็นเจ้าของข้อมูลที่ตนเองนำเข้าระบบ (Input Data) และผลการวิเคราะห์ที่สร้างจากข้อมูลนั้น

6. แพ็กเกจและการชำระเงิน

• ราคาแสดงเป็นสกุลเงินบาท (THB) ยังไม่รวม VAT 7%
• การชำระเงินรายปีได้รับส่วนลดสูงสุด 20%
• คืนเงินได้ภายใน 7 วันหลังชำระ หากยังไม่ได้ใช้ AI quota เกิน 10 ครั้ง
• Transforza สงวนสิทธิ์เปลี่ยนแปลงราคา โดยแจ้งล่วงหน้า 30 วัน

7. ข้อจำกัดความรับผิด

ในขอบเขตที่กฎหมายอนุญาต Transforza ไม่รับผิดชอบต่อความเสียหายทางอ้อม ความเสียหายที่เป็นผลพวง หรือความสูญเสียทางธุรกิจที่เกิดจากการใช้หรือไม่สามารถใช้บริการได้

ความรับผิดสูงสุดของ Transforza ต่อผู้ใช้รายหนึ่งจำกัดไม่เกินค่าบริการที่ได้รับในช่วง 3 เดือนก่อนเกิดเหตุ

8. การยกเลิกบริการ

• ผู้ใช้สามารถยกเลิกได้ทุกเมื่อ บริการจะสิ้นสุดเมื่อสิ้นรอบการชำระที่ชำระแล้ว
• Transforza สงวนสิทธิ์ระงับบัญชีที่ละเมิดข้อกำหนด โดยแจ้งล่วงหน้าหรือทันทีในกรณีร้ายแรง
• ข้อมูลจะถูกเก็บไว้ 30 วันหลังยกเลิก จากนั้นจะถูกลบถาวร

9. กฎหมายที่ใช้บังคับ

ข้อกำหนดนี้อยู่ภายใต้กฎหมายไทย ข้อพิพาทใดๆ ให้อยู่ในอำนาจศาลไทย

Terms of Service — please read carefully before using the Transforza platform

1. Acceptance of Terms

By accessing or registering a Transforza account, you agree to be bound by these Terms in full. If you do not agree, please discontinue use of the service.

2. Service Description

Transforza is a SaaS platform that uses AI to help analyze compliance and GRC risk and organizational processes, based on international standards such as ISO 27001, PDPA, NIST, SAP S/4HANA, and Microsoft D365 F&O.

Important limitation: Transforza's analysis output is preliminary AI-generated guidance only — it is not legal or professional advice. Users must make their own decisions and are responsible for their own actions.

3. User Accounts & Security

• You must provide accurate and truthful information when registering.
• You are responsible for keeping your password and tokens confidential.
• If you suspect unauthorized access to your account, notify hello@creativevaluation.com immediately.
• Transforza is not liable for damages arising from your disclosure of login credentials.

4. Prohibited Use

• You may not use the platform for illegal activity or to harm others.
• You may not reverse engineer, decompile, or attempt to access the system's source code.
• You may not scrape, use bots, or automated access other than through the authorized API.
• You may not upload malware or unlawful content.
• You may not share a single account across different organizations.

5. Intellectual Property

Transforza owns all UI/UX code, models, and infrastructure. You own the data you input into the system and the analysis results generated from it.

6. Plans & Payment

• Prices are shown in Thai Baht (THB), exclusive of 7% VAT.
• Annual billing receives up to a 20% discount.
• Refunds are available within 7 days of payment, provided you have not used more than 10 AI quota calls.
• Transforza reserves the right to change pricing with 30 days' notice.

7. Limitation of Liability

To the extent permitted by law, Transforza is not liable for indirect damages, consequential damages, or business losses arising from use or inability to use the service.

Transforza's maximum liability to any single user is limited to the fees paid in the 3 months preceding the incident.

8. Termination

• You may cancel at any time; service ends at the close of the current paid billing period.
• Transforza reserves the right to suspend accounts that violate these Terms, with notice in advance or immediately in serious cases.
• Data is retained for 30 days after cancellation, then permanently deleted.

9. Governing Law

These Terms are governed by the laws of Thailand. Any disputes are subject to the jurisdiction of the Thai courts.
